AMC3 2011

Welcome to the fourth year of the Appellate Moot Court Collegiate Challenge.

AMC3 is a groundbreaking program that fills a gap between moot court in law school and successful mock trial programs for high school and college students. Participation is limited to college students who are not in law school.

Legal teams of two to five members -- four is most typical -- argue each side of a hypothetical case before the Tennessee Intercollegiate Supreme Court.

AMC3 lawyers can also participate in TISL's lobbying program as lobbyists.

Briefs Due: Thursday, Nov. 3

Competition: Thursday, Nov. 17 - Sunday, Nov. 20, 2011

New in 2011

  • Justices will join the Jury of View in voting for winning teams.
  • Briefs and arguments may reference cases outside the closed List of Authorities insofar as they are quoted by a case in the List of Authorities.
  • Cases in the List of Authorities should be Shepardized.
  • The brief will count for 33 percent (up from 20 percent) of each team's score in every round.
  • Teams won't be identified by college name during oral arguments.
  • Attendance at oral arguments will be open to everyone.
  • Four teams (increased from two) will advance to the final round on Sunday morning.
  • The Petitioner may reserve up to seven (increased from five) minutes for rebuttal.

The Problem

Anna Nicole Smythe might be facing a very large medical bill after the death of her husband, J. Howard Marshall Smythe at a local hospital. The bill hasn't been paid, and the hospital sued Mrs. Smythe for payment.

Mrs. Smythe, however, says she's not responsible for the bill. She thinks that the legal requirement for a man to pay a woman's necessary bills doesn't work the other way and that she's not responsible for her beloved's final medical expenses. The appeals court agreed.

The hospital is appealing to the state Supreme Court, which has granted a Writ of Certiorari.

Teams will prepare a brief and arguments for the Supreme Court.
